Terms and Conditions

Effective August 2020.

These terms and conditions apply to all orders placed and all Accounts opened with Z-Tec Mobility ltd. By placing an order with us you are accepting the Terms and Conditions set out herein.

Throughout this Document the following definitions apply:

  • “Conditions” means the terms and conditions as set out in this document.

  • "Product" means any Product supplied by us in accordance with these Conditions.

  • “United Kingdom” and "UK" means England, Wales, Scotland, Northern Ireland and the Channel Islands.

  • “We / Us” means Z-Tec Mobility ltd and “Our” shall be construed accordingly.

  • "You” means any person ordering Products from us.

1. ACCOUNTS AND PAYMENT

1.1 All "on account" payments must be made by the end of the calendar month following the calendar month in which the date of the invoice falls.
1.2 Payment can be by Cheque or BACS payable to “Z-Tec Mobility ltd” sent to our office address, or by most major debit and credit cards.
1.3 Your Account is allocated a Credit Limit which will be notified to you and updated from time to time. The limit will be applied to the total account balance plus the value of new orders being placed.

2. TITLE TO GOODS

2.1 Title to Products supplied passes only when they and all earlier supplies are fully paid for.

3. PRICES AND CURRENCY

3.1 Prices shown by us are accurate on the date they were published and are subject to change.
3.2 All prices quoted by us are in (GBP) pounds sterling and are subject to VAT at the prevailing rate.

4. DELIVERY

4.1 Delivery of Products to UK addresses is usually by a nominated carrier chosen by us.
4.2 Subject to acceptance of your order, available credit and stock availability, despatch will normally be within 2 working days of receipt of order.
4.3 We will not be liable for late delivery of Products.

4.4 Time of despatch, time of delivery or time of any other aspect of our performance shall not be of the essence of any orders you place with us.
4.5 We reserve the right to make partial deliveries.
4.6 Delivery charges will apply to orders below our minimum order value agreed from time to time. Our delivery charges will be revised when necessary.
4.7 Delivery of orders which attract excess carriers' charges will be subject to increased Delivery Charges.
4.8 Please contact us if you have any special delivery requirements.

5. ORDER CANCELLATION PROCEDURE

5.1 Except where we have specially ordered Products for you, you may cancel the order at any time prior to Despatch
5.2 Where we have specially ordered Products for you and in the event of you cancelling the order, we reserve the right to invoice to you and you undertake to pay to us, charges up to the order value.

6. ASSEMBLY AND MINOR ADJUSTMENTS TO PRODUCTS

6.1 Products supplied to you may require assembly or minor adjustments before they can be shown to, sold to or used by your customers. These processes are your responsibility and are carried out at your own expense.

7. PRODUCT WARRANTY

7.1 Our Products which you sell or hire to your customers are covered by our conditional Product Warranty for a period of 12 months from date of first supply of the new Product. Repairs and adjustments required during the warranty period are your responsibility and are carried out at your own expense except for any parts required, which will be free-issued to you.

8. TRACEABILITY OF MOBILITY PRODUCTS YOU SELL

8.1 You need to keep the following records of customers to whom you have sold Mobility Product types we have supplied to you:

  1. Customer Name

  2. Customer Address and Post Code

  3. Date of Sale

  4. Z-Tec Product Number and Product Type supplied

  5. Product Serial Number

You and we are required by law to ensure that these types of product are fully traceable in this way and you are required to deliver these details to us on request from us.

9. RETURNS – UNUSED UNWANTED PRODUCTS

9.1  Return of the Products is at your expense and is your responsibility and must be to Z-Tec Mobility ltd address.
9.2 Provided that the Products are found on arrival at Z-Tec to be unused, in undamaged condition as despatched and in the original undamaged packaging, the goods will be credited at the original invoiced value less Distribution cost and less restocking fees as follows:

  • Within 2 weeks of Purchase No restocking fee

  • Over 2 weeks up to 2 months after Purchase 20% restocking fee

  • Over 2 months up to 6 months after Purchase 40% restocking fee

9.4 Where you return Products we have specially ordered for you the credit will be further reduced by appropriate charges up to the order value.

10. DEFECTIVE PRODUCTS

10.1 If you receive Products that are defective you must contact us within 7 working days of receipt of the Products with a clear statement of the defect.
10.2 Assembly and Minor Adjustments to Products and Product Warranty issues covered by Conditions 6 and 7 above do not constitute Defective Products under this condition.
10.3 We will either agree with you a means of rectifying the defects or (where appropriate in our Opinion) agree to replacement of the Products, subject to them being returned to us for inspection.
10.4 If the product is to be returned, Returns Documentation will be issued for you to complete and return with the returned Product, which must be in the original undamaged packaging.
10.5 Return of the Products is at your expense and is your responsibility and must be to Z-Tec Mobility ltd address.
10.6 Provided that the Products are found on arrival at Z-Tec to be defective as described and in the original undamaged packaging, the goods will be credited at the original invoiced value including any delivery charges and with allowance for return carriage.
10.7 Replacement Products will then be despatched and invoiced to you.

11. LIABILITY

11.1 In relation to the purchase of our Products, we accept no liability for indirect or consequential loss or damage or for any loss of data, profit or revenue or business (whether direct or indirect) however caused.
11.2 Our total liability for any loss, howsoever caused, relating to any of our products is limited to the original price charged for the product sold to you.

12. JURISDICTION

The Conditions shall be governed by and construed in accordance with the laws of England.

13. FORCE MAJEURE

We shall not be liable to you where performance of any of our obligations to you is prevented or impeded by any act of God, war and other hostilities, civil commotion, accident, strikes, lock outs, trade disputes, acts or restraints of Government or any other cause that is not reasonably within our control.

14. SEVERANCE

If any part of the Conditions shall be waived by us or be deemed unlawful, void or for any reason unenforceable, then that provision shall be deemed to be sever-able from the Conditions and shall not effect the validity and enforce-ability of any of the remaining provisions of the Conditions

15. STATUTORY RIGHTS
